ThePhotoBooth ("we", "us", "our", or "the Company") is committed to protecting the personal data of our clients, event guests, website visitors, and other individuals whose information we may collect in the course of our business. This Privacy Policy explains how we collect, use, disclose, transfer, store, and protect personal data in accordance with the Personal Data Protection Act 2012 of Singapore (PDPA) and any applicable subsidiary legislation, advisory guidelines, and codes of practice issued by the Personal Data Protection Commission ("PDPC").

By engaging our services, accessing our website, attending an event at which our photo booth is operating, submitting any personal data to us, or otherwise interacting with us, you acknowledge that you have read, understood, and agree to the terms set out in this Privacy Policy.

If you do not agree with any part of this Privacy Policy, please do not provide us with your personal data, use our services, or access our website.

This Privacy Policy should be read together with our Terms and Conditions, Booking Terms, and any specific consent forms or agreements signed between you and ThePhotoBooth.

3. Definitions

For the purposes of this Privacy Policy:

  • "Personal Data" means data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which we have or are likely to have access. This is consistent with the definition under the PDPA.
  • "Client" refers to any individual or organisation that engages or enquires about our services.
  • "Event Media" refers to all photographs, videos, GIFs, boomerangs, slow-motion clips, and other digital or printed media captured by our photo booth equipment or staff during an event.
  • "Services" refers to all photo booth rental, event photography, printing, digital media delivery, and related services provided by ThePhotoBooth.

4. Personal Data We Collect

We collect different categories of personal data depending on how you interact with us. These may include:

4.1 Information You Provide Directly

  • Full name, salutation, and preferred name
  • Contact information including email address, mobile number, and mailing address
  • Company or organisation name, designation, and business contact details
  • Billing information, payment details, and proof of payment (we do not store full credit card numbers; payment processing is handled by third-party payment gateways)
  • Event details such as date, time, venue, theme, expected guest count, and special requirements
  • Any correspondence, feedback, or enquiries submitted to us through email, contact forms, social media, or messaging applications
  • Any other information you voluntarily provide to us

4.2 Information Collected at Events

  • Photographs, videos, GIFs, boomerangs, and other media in which you appear, captured by our photo booth equipment or operators during an event
  • Names, email addresses, or mobile numbers provided by guests at the photo booth for the purpose of receiving digital copies of their photos
  • Audio recordings (only where audio guestbook or similar services are specifically engaged)
  • Digital signatures, props selections, or template choices made at the booth

4.3 Information Collected Through Our Website

  • IP address, browser type and version, device identifiers, operating system, and referring URL
  • Pages visited, time spent on pages, click activity, and other usage analytics
  • Cookies, pixels, and similar tracking technologies (see Section 13)
  • Information submitted through enquiry forms, quote request forms, or newsletter subscriptions

4.4 Information Collected from Third Parties

We may also receive personal data about you from:

  • Event organisers, wedding planners, corporate event managers, or other vendors collaborating on your event
  • Venues and venue operators
  • Referrers or persons who recommend our services
  • Publicly accessible sources, including social media platforms where you have tagged us or our content

We will only collect personal data from third parties where we have a lawful basis to do so under the PDPA.

5. How We Collect Personal Data

We collect personal data through the following channels:

  • Direct submission via our website forms, email enquiries, phone calls, and messaging platforms
  • Contractual paperwork including booking forms, quotations, invoices, and event briefs
  • Photo booth interactions during live events (capturing of media, sharing prompts, digital sharing forms)
  • Cookies and analytics tools on our website
  • Third-party referrals and partner introductions
  • In-person meetings, site recces, and event consultations

6. Purposes for Which We Collect, Use, and Disclose Personal Data

We collect, use, and disclose your personal data for one or more of the following purposes:

6.1 Service Delivery and Operations

  • Responding to enquiries, providing quotations, and confirming bookings
  • Planning, coordinating, and executing photo booth services at your event
  • Producing, processing, printing, and delivering Event Media to clients and guests
  • Hosting online galleries and providing access links
  • Communicating with you regarding event logistics, changes, and follow-ups
  • Managing accounts, invoicing, payment processing, and tax compliance

6.2 Customer Service and Relationship Management

  • Handling feedback, complaints, and dispute resolution
  • Conducting customer satisfaction surveys
  • Maintaining records of past engagements for service continuity

6.3 Marketing and Promotional Purposes (See Section 7 for Event Media specifically)

  • Sending newsletters, promotional offers, seasonal campaigns, and service updates (where you have consented or where permitted under the PDPA)
  • Inviting you to participate in events, contests, or loyalty programmes
  • Personalising marketing communications based on your preferences and past engagements

6.4 Business Administration and Legal Compliance

  • Internal record-keeping, audits, and quality assurance
  • Detecting, preventing, and investigating fraud, misconduct, or breaches of our terms
  • Complying with applicable laws, regulations, court orders, or lawful requests from government authorities
  • Establishing, exercising, or defending legal claims
  • Facilitating mergers, acquisitions, restructurings, or business transfers (in which case personal data may be transferred to the relevant successor entity)

7. Use of Event Photos and Videos for Marketing

This is an important section that applies to all clients who engage our services and to all event guests who interact with our photo booth.

7.1 Default Use of Event Media

By engaging ThePhotoBooth's services or by participating in our photo booth at any event, you acknowledge and agree that the photographs, videos, GIFs, boomerangs, and other Event Media captured during your event may be used by ThePhotoBooth for marketing, promotional, portfolio, and showcase purposes, unless you expressly opt out in writing prior to the event.

Such use may include, but is not limited to:

  • Publication on our website (www.thephotobooth.com.sg) including portfolio pages, gallery pages, and blog articles
  • Posts on our official social media accounts including Instagram, Facebook, TikTok, LinkedIn, YouTube, and any other platforms we operate or expand into
  • Inclusion in printed marketing collateral such as brochures, flyers, banners, posters, and event proposals
  • Use in digital advertisements, including paid social media ads, Google Ads, and display campaigns
  • Submission to industry awards, publications, and editorial features
  • Use in case studies, testimonials, pitch decks, and proposals shared with prospective clients
  • Use in showreels, behind-the-scenes content, and promotional videos
  • Inclusion in third-party platforms where we list our services (e.g. wedding directories, corporate event marketplaces, vendor showcase websites)

7.2 Opt-Out Mechanism for Clients

If you do not wish for Event Media from your event to be used for any of the purposes set out in Section 7.1, you must notify us in writing (email is acceptable) before the event date, by emailing sales@thephotobooth.com.sg or by indicating your preference in your booking form.

Where you have opted out:

  • We will not publish, share, or otherwise use the Event Media from your event for marketing or promotional purposes.
  • We will continue to use the Event Media solely for the purpose of fulfilling our service obligations to you (e.g. delivering the photos to you and your guests).
  • We may retain the Event Media in our internal archives for the retention period set out in Section 11, for legal, accounting, and operational reasons.

Please note that opt-out requests received after the event has taken place will apply on a best-efforts basis. While we will remove published material from platforms within our control as soon as reasonably practicable, we cannot guarantee removal from third-party reposts, screenshots, archives, or content already in circulation.

7.3 Guest Photographs

Guests attending an event may be photographed by our booth as part of the event experience. By stepping in front of our photo booth or participating in the photo-taking process, guests acknowledge that their image may be captured and used in accordance with this Privacy Policy and the arrangements between ThePhotoBooth and the event host.

Where the event host (the Client) has opted out under Section 7.2, no Event Media from that event will be used for marketing.

Where the event host has not opted out, individual guests who do not wish for their specific photographs to be used for our marketing purposes may submit a removal request to sales@thephotobooth.com.sg with sufficient identifying details (such as the event name, date, and a description or reference of the relevant photograph). We will action such requests within a reasonable time on a best-efforts basis.

7.4 Sensitive or Restricted Events

For certain events (e.g. private corporate functions, government events, events involving minors, religious ceremonies, or events with non-disclosure agreements in place), the default position in Section 7.1 may not apply. In such cases, the use of Event Media will be governed by the specific contractual terms agreed between us and the Client.

7.5 No Compensation

You acknowledge and agree that no fee, royalty, or other compensation is payable to you, your guests, or any other person for the use of Event Media in accordance with this Section 7.

8. Consent

8.1 Express Consent

Where required under the PDPA, we will seek your express consent before collecting, using, or disclosing your personal data. This may be obtained through booking forms, signed agreements, online forms, opt-in tick boxes, verbal confirmation, or other clear affirmative actions.

8.2 Deemed Consent

You may also be deemed to have consented to the collection, use, or disclosure of your personal data where you voluntarily provide it to us for a specific purpose, or where deemed consent applies under the PDPA (including deemed consent by notification, where applicable and where we have complied with the relevant assessment requirements).

8.3 Withdrawal of Consent

You may withdraw your consent for the collection, use, or disclosure of your personal data at any time by submitting a written request to our Data Protection Officer (see Section 17).

Upon receiving a withdrawal request, we will:

  • Inform you of the likely consequences of withdrawal, which may include our inability to continue providing services, deliver Event Media, or respond to your enquiries
  • Process the withdrawal within a reasonable time, generally not exceeding 30 days
  • Cease the relevant collection, use, or disclosure of personal data, except where retention is required for legal, regulatory, or legitimate business purposes

Withdrawal of consent does not affect the lawfulness of any processing carried out before the withdrawal.

9. Disclosure of Personal Data to Third Parties

We may disclose your personal data to the following categories of third parties, strictly for the purposes set out in this Policy:

9.1 Service Providers and Vendors

  • Cloud storage providers, gallery hosting platforms, and content delivery networks
  • Payment gateways and accounting service providers
  • Print production partners and photo printing vendors
  • IT service providers, software vendors, and analytics providers
  • Marketing agencies, social media management tools, and email marketing platforms
  • Couriers and delivery service providers (for printed deliverables)
  • Subcontractors, freelancers, and outsourced photo booth operators engaged for specific events

9.2 Business Partners

  • Event organisers, wedding planners, and venues collaborating on your event
  • Co-branded campaign partners (only with your consent or where contextually appropriate)

9.3 Legal and Regulatory Disclosures

  • Government agencies, regulators, law enforcement, and courts where required by law, court order, or legal process
  • Professional advisors including lawyers, auditors, and tax consultants
  • Insurance providers in connection with insurance claims or policies

9.4 Corporate Transactions

  • Prospective buyers, investors, or successors in the event of a sale, merger, acquisition, restructuring, or other corporate transaction involving ThePhotoBooth, subject to confidentiality obligations and applicable law

We require all third parties who handle personal data on our behalf to provide a standard of protection that is comparable to the protection required under the PDPA, through contractual obligations, data processing agreements, or equivalent arrangements.

We do not sell your personal data to any third party.

10. Transfer of Personal Data Outside Singapore

Some of the third parties and service providers we work with may be located outside Singapore, or may store data on servers located overseas (for example, cloud storage services with data centres in the United States, the European Union, or the Asia-Pacific region).

Where we transfer personal data outside of Singapore, we will take reasonable steps to ensure that the recipient is bound by legally enforceable obligations to provide a standard of protection comparable to that under the PDPA. This may include:

  • Entering into data transfer agreements containing PDPA-compliant clauses
  • Relying on the recipient's certifications under recognised data protection frameworks
  • Obtaining your consent where required

11. Retention of Personal Data

We retain personal data only for as long as is necessary to fulfil the purposes for which it was collected, or as required by applicable law, contractual obligations, or legitimate business needs.

Indicative retention periods include:

  • Event booking records, contracts, and invoices: Retained for at least 5 years after the conclusion of the engagement, in line with statutory record-keeping requirements under Singapore tax and accounting laws
  • Event Media (photos, videos, GIFs): Retained on our cloud galleries for the period stated in your booking package (typically between 30 days and 12 months for client-facing galleries), and in our internal archives for portfolio, reference, and marketing purposes (subject to opt-out under Section 7)
  • Marketing contact lists: Retained until you unsubscribe or withdraw consent
  • Website analytics data: Retained in accordance with our analytics tools' default retention settings, typically up to 26 months
  • Enquiry records: Retained for up to 24 months from the date of last interaction, where no booking materialises

When personal data is no longer required for any legal or business purpose, we will take reasonable steps to delete, anonymise, or destroy it in a secure manner.

12. Protection of Personal Data

We take reasonable and appropriate technical, administrative, and physical security measures to protect personal data in our possession or under our control against unauthorised access, collection, use, disclosure, copying, modification, disposal, or similar risks.

These measures include:

  • Encrypted storage of digital files where practicable
  • Access controls, role-based permissions, and password protection on systems holding personal data
  • Restricting access to personal data to authorised personnel on a need-to-know basis
  • Use of reputable cloud storage providers with industry-standard security certifications
  • Regular review of security practices and staff training on data protection responsibilities
  • Confidentiality and data protection clauses in contracts with employees, contractors, and vendors
  • Secure disposal of physical documents and digital media

While we take reasonable steps to safeguard personal data, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security, and you provide your personal data to us at your own risk.

In the event of a data breach involving your personal data that is likely to result in significant harm or that affects 500 or more individuals, we will notify the PDPC and affected individuals as required under the PDPA.

Our services are intended for clients aged 18 and above. We do not knowingly collect personal data directly from individuals under the age of 13 without verifiable parental or guardian consent.

For events involving minors (such as children's birthday parties, school events, or family functions), the booking adult, parent, or guardian is responsible for providing appropriate consent on behalf of any minors photographed. If a parent or guardian becomes aware that a minor has provided personal data to us without appropriate consent, please contact our Data Protection Officer and we will take steps to remove such data.

16. Your Rights Under the PDPA

Subject to certain conditions and exceptions under the PDPA, you have the following rights in relation to your personal data:

16.1 Right of Access

You may request access to the personal data we hold about you, and information about how it has been used or disclosed in the past 12 months.

16.2 Right of Correction

You may request that we correct any errors or omissions in the personal data we hold about you.

16.3 Right to Withdraw Consent

You may withdraw your consent to the collection, use, or disclosure of your personal data at any time, subject to Section 8.3.

16.4 Right to Data Portability (where applicable)

Where data portability provisions under the PDPA come into force and apply to your personal data, you may request the transmission of certain personal data to another organisation in a commonly used machine-readable format.

16.5 How to Exercise Your Rights

To exercise any of the above rights, please submit a written request to our Data Protection Officer (see Section 17). We may require you to verify your identity before processing your request.

A reasonable administrative fee may be charged for access requests, in accordance with the PDPA. We will inform you of any applicable fee in advance.

We will respond to your request within 30 days. If we are unable to do so within this period, we will inform you of the expected response time.

We reserve the right to refuse access or correction requests in the limited circumstances permitted under the PDPA, including where compliance would compromise the privacy of another individual, reveal confidential commercial information, or where the request is frivolous or vexatious.

19. Governing Law and Jurisdiction
