1. Introduction

These Terms and Conditions ("Terms") govern the engagement of services provided by ThePhotoBooth ("we", "us", "our", or "the Company") and form a legally binding agreement between ThePhotoBooth and any individual or organisation booking, engaging, or otherwise utilising our services ("Client", "you", or "your").

By submitting a booking, paying a deposit, signing a quotation or invoice, attending an event at which our photo booth is operating, or otherwise engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms together with our Privacy Policy.

If you are entering into these Terms on behalf of a company, organisation, or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Definitions

For the purposes of these Terms:

  • "Booking" means the engagement of ThePhotoBooth's services confirmed in writing (including by email) and supported by payment of the required deposit.
  • "Event" means the function, occasion, or activity at which ThePhotoBooth's services are to be provided, as specified in the Booking.
  • "Event Media" means all photographs, videos, GIFs, boomerangs, slow-motion clips, and other digital or printed media captured by our photo booth equipment or staff during the Event.
  • "Equipment" means all photo booth units, cameras, lighting, printers, props, backdrops, tablets, computers, and any other hardware or accessories provided by ThePhotoBooth at the Event.
  • "Services" means all photo booth rental, event activation, printing, digital media delivery, and related services provided by ThePhotoBooth as described in the relevant quotation or booking confirmation.
  • "Venue" means the location at which the Event is held.

3. Booking and Confirmation

3.1 Booking Process

Bookings may be made via our website, email, phone, WhatsApp, or in person. A Booking is only confirmed upon:

(a) Receipt of a signed quotation, booking form, or written confirmation (email is acceptable); and(b) Receipt of the required non-refundable deposit (see Section 4).

3.2 Provisional Holds

We may, at our sole discretion, hold a date for a prospective Client on a provisional basis for a limited period (typically up to 7 calendar days) pending confirmation. Provisional holds do not constitute a confirmed Booking and may be released without notice if another Client confirms the same date.

3.3 Accuracy of Information

You are responsible for ensuring that all information provided to us in connection with the Booking — including event date, start and end times, venue address, contact details, guest count, and any specific requirements — is accurate and complete. ThePhotoBooth shall not be liable for any service failure, delay, or additional cost arising from inaccurate or incomplete information provided by you.

3.4 Changes to Booking

Any request to amend the Booking (including changes to date, time, venue, package, or scope of services) must be submitted to us in writing as early as possible. We will use reasonable efforts to accommodate such requests but cannot guarantee availability. Changes may result in additional charges or revised pricing, which will be communicated to you for approval before being actioned.

4. Fees, Deposits, and Payment

4.1 Pricing

All fees are as set out in the relevant quotation or booking confirmation. Unless otherwise stated, fees are quoted in Singapore Dollars (SGD) and are inclusive of standard service delivery within mainland Singapore. Prevailing Goods and Services Tax (GST), where applicable, will be charged in addition.

4.2 Deposit

A non-refundable deposit of fifty percent (50%) of the total contract value (or such other amount as specified in your quotation) is required to confirm the Booking. The Booking is not deemed confirmed until the deposit has been received in cleared funds.

4.3 Final Payment

The remaining balance is payable no later than seven (7) calendar days before the Event date, unless otherwise agreed in writing. ThePhotoBooth reserves the right to withhold provision of the Services if full payment has not been received by the due date.

4.4 Late Payment

Any payment not received by the due date may attract a late payment administrative fee of SGD 50 per week or part thereof, at our discretion. We reserve the right to suspend, postpone, or cancel the Booking for non-payment, without prejudice to our right to recover any outstanding sums.

4.5 Method of Payment

Payment may be made by bank transfer, PayNow, cheque, or such other methods as we may accept from time to time. Payment details will be provided in your invoice. You are responsible for any bank charges, transaction fees, or currency conversion costs.

4.6 Additional Charges

Additional charges may apply for, but are not limited to:

(a) Overtime beyond the contracted service hours (charged in 30-minute or 1-hour blocks at our prevailing rate
(b) Extended setup or teardown time required by venue restrictions(c) Travel, parking, ERP, or accommodation costs for events outside standard service areas(d) Loading/unloading fees, manual carrying surcharges where lift access is unavailable, or labour charges for difficult-access venues(e) Last-minute customisation, reprinting, or design revisions(f) Replacement of damaged or lost props, backdrops, or Equipment (see Section 9)

All additional charges will be invoiced separately and are payable within 7 days of the invoice date.

5. Cancellation and Postponement

5.1 Cancellation by the Client

In the event of cancellation by the Client, the following terms apply:

(a) More than 30 days before the Event: The deposit is forfeited. No further charges apply.
(b) 15 to 30 days before the Event: 75% of the total contract value is payable.
(c) 7 to 14 days before the Event: 90% of the total contract value is payable.
(d) Less than 7 days before the Event: 100% of the total contract value is payable.

Cancellation must be submitted in writing to sales@thephotobooth.com.sg. The cancellation date is the date on which we receive written notice.

5.2 Postponement by the Client

We will use reasonable efforts to accommodate postponement requests, subject to availability. The following terms apply:

(a) More than 14 days before the Event: One postponement may be permitted at no additional charge, subject to availability of the new date within 12 months of the original Event date.(b) Less than 14 days before the Event: An administrative fee of 25% of the total contract value, or such other amount as we may reasonably determine, may be charged.(c) Postponements beyond 12 months from the original Event date will be treated as cancellations under Section 5.1.

If the new date is unavailable on our calendar, the Booking will be treated as a cancellation under Section 5.1.

5.3 Cancellation by ThePhotoBooth

We reserve the right to cancel the Booking in the following circumstances:

(a) Non-payment of the deposit or final balance by the due date(b) Material breach of these Terms by the Client(c) Force majeure events (see Section 13)(d) Health, safety, or operational reasons that make provision of the Services unsafe or unfeasible(e) Where the Event involves illegal activity, or where the Venue or the nature of the Event poses an unreasonable risk to our staff or Equipment

Where we cancel under sub-paragraphs (a) or (b) above, the Client shall not be entitled to a refund of any sums paid. Where we cancel under sub-paragraphs (c), (d), or (e) above, we will refund any sums paid in excess of work already performed and costs already incurred, but shall not be liable for any further compensation, loss, or damages.

6. Service Delivery

6.1 Setup and Teardown

(a) Our staff will arrive at the Venue at least 60 minutes before the contracted start time for setup, unless otherwise agreed.(b) Setup and teardown time is not counted as part of the contracted service hours.(c) Where setup is delayed due to factors outside our control (e.g. venue access, late access permissions, road conditions, traffic), the Service end time will not be extended unless additional fees are paid.

6.2 Service Hours

The Services will be provided for the duration specified in the Booking. Idle hours, where the photo booth is set up but not in active operation (e.g. during the wedding ceremony or solemnisation), may be charged at a reduced rate as agreed in the quotation.

6.3 Operator Coverage

Unless otherwise specified, our standard packages include one trained photo booth operator on site. Additional operators, if required, will be charged accordingly.

6.4 Delivery of Event Media

(a) Digital copies of the Event Media will typically be delivered via an online gallery link within 7 to 14 working days after the Event, unless otherwise specified in your package.(b) Printed photos provided on the day of the Event are produced live at the booth; quantity and format are as per the agreed package.(c) Online galleries are typically hosted for a period of 30 days to 12 months, depending on the package. Clients are responsible for downloading and retaining a personal copy of the Event Media before the gallery expires.(d) ThePhotoBooth shall not be obliged to retain Event Media beyond the retention period stated in our Privacy Policy or in the booking package.

6.5 Customisation and Design Approval

Where the Booking includes custom-designed photo templates, overlays, GIFs, animations, backdrops, or other branded collateral:

(a) The Client must provide all required logos, artwork, brand guidelines, text, and other content in suitable digital formats by the deadline specified in the booking timeline.(b) Up to two (2) rounds of revisions are included as standard. Additional revisions may incur a design fee.(c) The Client is responsible for reviewing and approving final designs in writing before production. Once approved, ThePhotoBooth shall not be liable for any errors, typos, or omissions present in the approved design.(d) Late submission of design assets may delay production. We do not guarantee delivery if assets are submitted less than 7 working days before the Event.

7. Client Responsibilities

The Client shall be responsible for the following at no cost to ThePhotoBooth:

7.1 Venue Access and Setup Conditions

(a) Providing a level, dry, sheltered, and safe operating space of approximately 3 metres by 3 metres (or such other dimensions as advised), with adequate ceiling height(b) Securing all necessary venue permissions, permits, and approvals for the photo booth setup, including building management approvals, vendor passes, and access permits(c) Providing access to the Venue at least 60 minutes before the contracted start time for setup, and a reasonable time after the contracted end time for teardown(d) Notifying us in advance of any venue restrictions, including lift dimensions, loading bay access, parking arrangements, stair-only access, time-restricted loading, or noise restrictions

7.2 Power Supply

(a) Providing a stable, dedicated power supply (standard Singapore 230V/13A power outlet) within 3 metres of the photo booth setup location(b) For outdoor events or venues without standard power, the Client must arrange suitable power generation equipment (e.g. silent generator) at their own cost

7.3 Internet Connectivity (Where Required)

For services that require live digital sharing, social media uploads, live galleries, or live slideshows, the Client is responsible for providing a stable Wi-Fi or wired internet connection at the booth location. Where internet is unavailable or unreliable, ThePhotoBooth shall not be liable for delays or failures in digital sharing functionality.

7.4 Guest Conduct

(a) Ensuring that guests treat our staff, Equipment, and props with respect and care(b) Ensuring that guests follow reasonable instructions from our operators(c) Refraining from allowing guests to consume food, drinks, or use any substances near the Equipment that may pose a risk of damage(d) Compensating ThePhotoBooth for any loss, damage, or theft of Equipment or props caused by the Client's guests, attendees, or any third parties under the Client's control (see Section 9)

7.5 Safety and Security

The Client shall ensure a safe operating environment for our staff and Equipment, free from harassment, threats, intoxicated misbehaviour, or any conditions likely to endanger safety. Where our staff feel unsafe, we reserve the right to pause or cease provision of the Services without refund.

8. Equipment, Props, and Use

8.1 Ownership

All Equipment, props, backdrops, software, and other materials supplied by ThePhotoBooth remain the sole property of the Company at all times. Nothing in these Terms transfers any ownership interest to the Client.

8.2 Permitted Use

The Equipment is to be used solely for the purposes of the Event and only by our trained operators or under our supervision. The Client and the Client's guests shall not:

(a) Tamper with, modify, dismantle, or attempt to repair any Equipment(b) Move or relocate the Equipment without our consent(c) Use the Equipment for any unlawful, indecent, defamatory, or otherwise objectionable purpose(d) Allow children to operate the Equipment unsupervised

8.3 Props

Standard props are provided as part of our service. Premium, themed, or custom props may incur additional charges as set out in the quotation. Props are provided on a rental basis and must be returned in the same condition (fair wear and tear excepted).

9. Loss, Damage, and Liability

9.1 Damage to Equipment or Props

The Client shall be liable for the full cost of repair or replacement (at current retail value) of any Equipment, props, or materials lost, stolen, or damaged during the Event due to the actions or omissions of the Client, their guests, attendees, vendors, or any other person under the Client's control. Replacement costs will be invoiced separately and are payable within 7 days.

9.2 Limitation of Liability

To the fullest extent permitted by law:

(a) ThePhotoBooth's total aggregate liability under or in connection with these Terms (whether in contract, tort, negligence, breach of statutory duty, or otherwise) shall not exceed the total fees paid by the Client for the relevant Booking.(b) ThePhotoBooth shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of business, loss of goodwill, loss of data, or loss of opportunity.(c) ThePhotoBooth shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including those set out in Section 13.

9.3 Equipment Failure

While we use professional-grade Equipment and conduct routine maintenance, we cannot guarantee that the Equipment will be free from technical issues. In the unlikely event of Equipment failure during the Event:

(a) Our operators will use reasonable efforts to resolve the issue or substitute backup Equipment.(b) Where the issue results in significant downtime that cannot be resolved, we may, at our sole discretion, offer a partial refund or service credit proportionate to the affected period.(c) We shall not be liable for any further compensation beyond the proportionate refund or credit.

9.4 Quality of Event Media

While we strive to deliver high-quality Event Media, the final output is influenced by factors such as lighting conditions, venue characteristics, guest cooperation, and the nature of the Event. The Client acknowledges that Event Media is delivered on an "as-is" basis, and we make no guarantee that every photograph will meet a particular subjective standard.

9.5 No Liability for Third-Party Acts

ThePhotoBooth shall not be liable for any loss, damage, injury, or inconvenience caused by the acts or omissions of third parties at the Event, including but not limited to other vendors, venue staff, guests, or contractors not engaged by us.

9.6 Personal Property of Guests

ThePhotoBooth shall not be responsible for the safekeeping of any personal items, valuables, or belongings left near the photo booth area. Guests use the photo booth area at their own risk.

10. Intellectual Property and Use of Event Media

10.1 Ownership of Event Media

All Event Media captured by ThePhotoBooth's Equipment or staff remains the intellectual property of ThePhotoBooth. The Client and their guests are granted a non-exclusive, royalty-free, worldwide licence to use the Event Media for personal, non-commercial purposes, including printing, sharing on personal social media, and use in personal albums.

10.2 Commercial Use by the Client

If the Client wishes to use the Event Media for commercial purposes (including but not limited to corporate marketing, advertising, press releases, paid social media campaigns, or resale), additional commercial usage rights must be agreed in writing and may be subject to additional fees.

10.3 Marketing Use by ThePhotoBooth

By engaging our Services, the Client acknowledges and agrees that ThePhotoBooth may use the Event Media for marketing, promotional, portfolio, and showcase purposes, including but not limited to publication on our website, social media accounts, brochures, advertisements, and pitch materials, in accordance with Section 7 of our Privacy Policy.

If the Client does not wish for the Event Media to be used in this manner, the Client must opt out in writing before the Event date, in accordance with the procedure set out in our Privacy Policy.

10.4 Client-Provided Materials

The Client warrants that any logos, artwork, text, music, or other content provided to ThePhotoBooth for use in design templates, overlays, or branded collateral does not infringe the intellectual property rights, privacy rights, or any other rights of any third party. The Client agrees to indemnify and hold ThePhotoBooth harmless against any claims, damages, or costs arising from the use of such Client-provided materials.

10.5 ThePhotoBooth Branding

ThePhotoBooth may include subtle branding (such as a small logo or watermark) on photo prints, digital templates, or galleries. Removal or customisation of such branding may be available at an additional cost and must be agreed at the time of booking.

11. Privacy and Data Protection

The collection, use, and disclosure of personal data in connection with our Services is governed by our Privacy Policy, available at www.thephotobooth.com.sg/privacy-policy. By engaging our Services, the Client confirms that they have read and agreed to the Privacy Policy and shall ensure that their guests are made aware of it where relevant.

The Client further agrees to assist ThePhotoBooth in complying with the Personal Data Protection Act 2012 of Singapore, including by ensuring that any personal data of guests provided to us has been collected lawfully and that necessary consents have been obtained.

12. Indemnity

The Client agrees to indemnify, defend, and hold harmless ThePhotoBooth, its directors, employees, contractors, and agents from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

(a) The Client's breach of these Terms(b) The Client's or the Client's guests' use of the Services or Equipment(c) Any negligent, wilful, or unlawful act or omission of the Client or the Client's guests, attendees, or vendors(d) Any third-party claim relating to materials, content, logos, or instructions provided by the Client(e) Any injury, damage, or loss caused at the Event that is not attributable to ThePhotoBooth's negligence

13. Force Majeure

ThePhotoBooth shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by events beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, severe weather, flooding, fire
  • Pandemic, epidemic, public health emergency, or government-imposed restrictions
  • War, terrorism, civil unrest, riots, or strikes
  • Power outages, internet failures, or telecommunication disruptions at the Venue
  • Government actions, regulatory changes, or imposition of curfews or restrictions
  • Major traffic disruptions, road closures, or transport breakdowns
  • Sudden illness, injury, or unavailability of key staff
  • Failure or breakdown of Equipment despite reasonable maintenance, where backup is unavailable due to circumstances beyond our control

In a force majeure event, we will use reasonable efforts to:

(a) Notify the Client as soon as practicable(b) Reschedule the Event to a mutually agreed date within 12 months, where feasible(c) Provide a substitute service or arrangement of equivalent quality, where feasible

If rescheduling or substitution is not feasible, we will refund any unused portion of fees paid (less reasonable costs incurred). We shall not be liable for any further compensation, loss, or damages.

14. Confidentiality

Where the Client provides confidential information (including but not limited to event briefs, guest lists, branding materials, or commercial arrangements), ThePhotoBooth agrees to keep such information confidential and to use it only for the purposes of providing the Services.

This obligation shall not apply to information that:

(a) Is already in the public domain through no fault of ThePhotoBooth(b) Is independently developed by ThePhotoBooth(c) Is required to be disclosed by law, court order, or regulatory authority

ThePhotoBooth may engage subcontractors and service providers (such as printing partners or freelance operators) and may share necessary information with them, subject to comparable confidentiality obligations.

15. Subcontracting

ThePhotoBooth reserves the right to subcontract or assign any of its obligations under these Terms to qualified third parties or freelance operators. We remain responsible for the standard of work performed by our subcontractors.

16. Insurance

ThePhotoBooth maintains reasonable business insurance, including public liability cover where applicable. The Client is responsible for arranging their own insurance for the Event, the Venue, and any guest-related risks. ThePhotoBooth is not liable for personal injury, property damage, or losses suffered by the Client, guests, or third parties at the Event, except to the extent caused by our gross negligence or wilful misconduct.

17. Complaints and Dispute Resolution

17.1 Complaints

If you have any complaints regarding the Services, please notify us in writing at sales@thephotobooth.com.sg within 7 calendar days of the Event. We will investigate and respond within a reasonable time.

17.2 Amicable Resolution

The parties agree to first attempt to resolve any dispute amicably through good-faith discussion before initiating any formal proceedings.

17.3 Mediation

If the dispute cannot be resolved through direct discussion within 30 days, the parties may refer the matter to mediation at the Singapore Mediation Centre (SMC) before commencing court proceedings.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. The parties submit to the exclusive jurisdiction of the courts of Singapore in respect of any disputes arising out of or in connection with these Terms.

19. General Provisions

19.1 Entire Agreement

These Terms, together with the relevant quotation, booking confirmation, and our Privacy Policy, constitute the entire agreement between the parties and supersede all prior representations, communications, or agreements (whether written or oral) relating to the subject matter.

19.2 Variation

No variation of these Terms shall be effective unless made in writing and agreed by both parties.

19.3 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

19.4 Waiver

A failure or delay by either party to exercise any right under these Terms shall not constitute a waiver of that right.

19.5 No Partnership

Nothing in these Terms shall constitute a partnership, joint venture, agency, or employment relationship between the parties.

19.6 Notices

All formal notices under these Terms shall be sent by email to the addresses specified in the booking confirmation, or by registered post to the registered business addresses of the parties.

19.7 Assignment

The Client may not assign or transfer any of its rights or obligations under these Terms without the prior written consent of ThePhotoBooth. ThePhotoBooth may assign or transfer its rights and obligations as part of a corporate restructuring, sale, or transfer of business.

19.8 Third-Party Rights

A person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any term of these Terms.

20. Amendments to These Terms

ThePhotoBooth reserves the right to amend or update these Terms from time to time. The latest version will always be available on our website at www.thephotobooth.com.sg. Amendments will not apply retrospectively to confirmed Bookings, which will continue to be governed by the version of the Terms in force at the time of booking confirmation.

22. Acknowledgement

By submitting a booking, paying a deposit, signing a quotation or invoice, or engaging our Services in any manner, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions in their entirety.
